Terms of Service

1. Acceptance of these Terms

By accessing or using StashGram (the "Service") through the Telegram Mini App @stash_gram_bot or the website stash-gram.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is higher. You also affirm that you are not located in a country or on a list that prohibits you from receiving services under applicable export-control or sanctions laws.

2. What the Service does

StashGram is a peer-to-peer marketplace for digital goods. Users may create listings ("Creators"), browse and purchase listings using Telegram Stars ("Buyers"), and write reviews of products they have purchased. Payment for transactions is processed exclusively by Telegram via Telegram Stars; we do not process or store payment-card data.

3. Your account

Your account is your Telegram account. You are responsible for any activity that occurs through your Telegram account on the Service, including activity by anyone you allow to access your Telegram account. You agree to keep your Telegram account secure.

4. Creator obligations

If you publish products you represent and warrant that:

• You own all intellectual property in the product you list, or have a valid

license to distribute it under these Terms.

• The product is not illegal, fraudulent, deceptive, infringing, malicious

(including malware, spyware, or phishing), sexually explicit involving minors, promoting violence or hatred, or otherwise prohibited under Telegram's terms or the laws applicable to the laws of your jurisdiction (TODO: replace with e.g. Italy / Delaware / etc.).

• The "delivery payload" (download link, file, token, or text) you provide

is exactly what buyers will receive on payment.

• You will respond to legitimate refund or dispute requests in good faith.

You grant StashGram a non-exclusive, royalty-free license to host, display, transmit, and process your listings (including title, description, images, and the file you uploaded) solely for the purpose of operating the Service.

We reserve the right, at our sole discretion and without prior notice, to remove any listing, suspend any account, withhold any pending payout, or refuse service for any reason, including without limitation a credible report of a Terms violation.

5. Buyer obligations

When you purchase a product:

• All Telegram Stars payments are final at the point of confirmation.

Refunds are at Telegram's discretion under Telegram's policies, except where StashGram chooses to honor a refund of its platform fee in cases of clearly fraudulent or undelivered goods.

• You must not redistribute, resell, or share the delivered file or

download link beyond what the Creator's license permits.

• You must use the Service for personal, non-commercial purposes unless

the Creator has granted you a commercial license.

6. Reviews

Reviews must be written by buyers who actually purchased the product. We enforce this technically: only completed purchases can post a review, and each buyer can post at most one review per product. Reviews may be moderated or removed if they are off-topic, defamatory, contain personal information, or violate these Terms.

7. Platform fees

StashGram retains a percentage of the gross sale price as a platform fee. The current rate is displayed in the Mini App and may change on notice. The remainder is credited to the Creator's balance in Telegram Stars. Payouts from the in-app balance are subject to Telegram Stars withdrawal rules and any future payout policy we publish.

8. Prohibited conduct

You may not:

• Use the Service in violation of any law or regulation.
• Reverse engineer, decompile, scrape at scale, or otherwise attempt to

extract source code or non-public data.

• Probe, scan, or test the vulnerability of the Service except through a

responsibly disclosed security report to caio.ricciuti07@gmail.com.

• Interfere with or disrupt the Service or its servers.
• Use the Service to send spam or unsolicited messages.
• Impersonate any person or misrepresent your affiliation.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, NOR THAT ANY LISTING OFFERED ON THE SERVICE IS ACCURATE, LEGAL, OR FREE OF DEFECTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL StashGram, ITS AFFILIATES, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE PLATFORM FEES WE RETAINED FROM YOUR TRANSACTIONS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) FIFTY (50) TELEGRAM STARS.

11. Indemnification

You agree to indemnify and hold harmless StashGram and its affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your listings, your reviews, or your breach of these Terms.

12. Termination

We may suspend or terminate your access at any time, with or without notice, for any reason, including a violation of these Terms. You may stop using the Service at any time. Provisions of these Terms that by their nature should survive termination (intellectual-property, disclaimers, limitations of liability, indemnification, governing law) will survive.

13. Changes

We may modify these Terms at any time. Continued use after a change constitutes acceptance of the new Terms. We will update the "Effective" date below when changes are made.

14. Governing law

These Terms are governed by and construed in accordance with the laws of your jurisdiction (TODO: replace with e.g. Italy / Delaware / etc.), without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the courts located in that jurisdiction, and you consent to personal jurisdiction there.
